Instituto da Criança

FAQ

  • IS THE CHILDREN’S INSTITUTE A DAY CARE?

No, we are not a day care nor a nursery. The Children’s Institute is an instrument of social transformation consisting of staff and volunteers who work with existing social institutions, initiates its own social outreach programs, and assists companies in implementing corporate social responsibility. The IC provides administrative, financial and legal support and direction to existing social organizations, tracking their progress through ongoing accountability.

  • WHAT IS AN NGO?

An NGO, or non-governmental organization, is any social group (meeting of people, or group of assets linked to pre-defined social purposes) that is not a branch of the government.

Affiliation as an NGO does not classify an organization as a legal entity. In Brazil, Article 44 of the Civil Code states that legal entities of private law are "the associations, societies, foundations, religious organizations and political parties." NGOs are registered, and organized associations or foundations are included in this Third Sector group.

Association - a group of people that seek to benefit from a community and/or mutually benefit, but does not aim to result in the economic interest or profit of its members or administrators.

  • WHAT IS THE THIRD SECTOR?

The Third Sector consists and brings together organizations, often providing public services, to produce and market goods and services unaffiliated with the state. The organizations in this sector do not seek financial gain for its members or administrators through their development and results. Therefore, the Third Sector is made up mostly of associations, foundations, and legal non-profits.

  • WHAT IS AN OSCIP?

Instituto da Criança is registered in Brazil as an OSCIP, a Civil Society Organization of Public Interest, created by Law No. 9.790/99, regulated by Decree No. 3100/99 and having established a partnership agreement.

The OSCIP is the qualification that can be obtained by non-profit organizations in Brazil. It was created from the rounds of interaction by the Solidarity Community Council with the participation of civil society organizations. These organizations identified the need to reform the legal framework of the Third Sector since adequate laws to meet their demands did not previously exist.

This framework originated from the belief that it was necessary to strengthen civil society organizations providing public services to create the most favorable, effective and transparent relationship between them and the government. Merely existing as an association or foundation does not deem an organization an OSCIP however. Rather, there are statutory provisions to be classified as an OSCIP which include the possibility to pay their leaders.
